Terms and Conditions for Coaching Services

1. Scope
These General Terms and Conditions (GTC) apply to all coaching services provided by [Beatrix Aschenwald/Trixi-Coaching], in particular to business and career coaching in the form of one-to-one sessions conducted online or in person.
Any deviating terms and conditions of the client shall only apply if they have been confirmed in writing.

2. Conclusion of Contract
A contract is concluded through:
• written or electronic confirmation of an appointment
• booking of an individual coaching session, a coaching package or a subscription
• use of the service
The coaching process is tailored to the individual. Adjustments to the approach are possible at any time and form part of the collaboration.

3. Services and Scope
Coaching is a professional support process designed to promote reflection, development and decision-making skills.
It does not include psychotherapy, medical treatment, legal or tax advice
Clients bear responsibility for their decisions and outcomes.
Active participation by the client is a prerequisite for the success of the coaching.
I work in accordance with the ethical guidelines of the ICF/DBVC..

4. Fees and Terms of Payment
• The prices communicated at the time of booking apply.
• Coaching can be booked as a single session, a package or a subscription.
• Invoices are payable within 10 days, unless otherwise agreed.
• For subscriptions or packages, the total amount is payable before the start of the first session.
• Price changes will be communicated in good time and do not apply retrospectively to services already booked.

5. Appointment cancellations and cancellations
• Cancellations or rescheduling are possible free of charge up to 24 hours before the appointment.
• In the event of last-minute cancellations or no-shows, the full amount will be charged.
• In the event of illness or unforeseen circumstances affecting the coach, the appointment will be rescheduled free of charge.

6. Conduct
Coaching sessions take place online.
In the event of technical difficulties, a solution will be sought jointly; there is no entitlement to compensation or liability.
The coach may reschedule appointments for important reasons; in this case, no costs will be incurred by the client.

7. Confidentiality
The coach treats all information arising from the coaching as strictly confidential.
Content will not be disclosed to third parties without the client’s express consent.
This also applies to notes, digital documents and communication records.

8. Data Protection (in accordance with the Swiss Data Protection Act, revDSG;, see also: → Privacy Policy)
• Personenbezogene Daten werden ausschliesslich zur Erbringung der Coaching-Dienstleistung verwendet.
• Daten werden sicher gespeichert und nicht an Dritte weitergegeben, ausser es besteht eine gesetzliche Pflicht oder eine ausdrückliche Einwilligung.
• Clients have the right to access, rectify and erase their data in accordance with the relevant legal provisions.
• When using online tools (e.g. Zoom, Teams), their respective privacy policies also apply.

9. Disclaimer
The coach shall not be liable for clients’ decisions, actions or outcomes.
No guarantee is given regarding specific outcomes or developments.
Liability for slight negligence is excluded to the extent permitted by law.

10. Jurisdiction and Applicable Law
Swiss law applies.
The place of jurisdiction is the registered office of the company or the place of residence of the coach:

11. Severability clause
Should any individual provisions of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
